Abrogation Of Article 370 Irreversible, Centre Tells SC

Mumbai: The central government told the Supreme Court that the repeal of Article 370 allowed Jammu and Kashmir to enter the Indian Union and said the move was “irreversible”.

A five-judge constitution bench of Justices NV Ramana, SK Kaul, R Subhash Reddy, BR Gavai and Surya Kant continued to hear various petitions challenging the repeal of Article 370, which gave special status to the erstwhile state of Jammu and Kashmir.

Attorney General KK Venugopal presented how the new union territory entered Indian territory and said: “it (violation of Article 370) is irreversible”.

Venugopal told the court, “I want to state that the sovereignty of Jammu and Kashmir was indeed temporary. We are one state.”

The advocate appearing on behalf of one of the petitioners, Dr Rajiv Dhawan said: “For the first time, using Article 3 of the Constitution of India, a state was given the status of a union territory. If they (the centre) do so for a state.”

Dhawan said that the central government deliberately imposed President’s rule in the then state and pointed to the map of Jammu and Kashmir. Solicitor General Tushar Mehta, who was representing Jammu and Kashmir, interrupted Dhawan and said: “what he is saying is irrelevant”.

To this, Dhawan replied, “If the Attorney General can bring Nehru (JL) in his historic visit, I can certainly show the millers a map. I don’t need to get your permission.”

The apex court on Wednesday also heard petitions that were filed after the central government abolished Article 370 in August last year and divided Jammu and Kashmir into two union territories – Jammu and Kashmir and Ladakh.
