CJI Sexual Harassment: Husband, Brother-in-law of Woman Complainant Reinstated as Police Constables

Mumbai: As per reports, the Delhi Police has reinstated the job of the husband and brother-in-law of the woman who accused the Chief Justice of India (CJI) Ranjan Gogoi for sexual harassment.

The two have been reinstated as head constables of Delhi Police, The Indian Express reported on Thursday.

Additional Commissioner of Police (Delhi Armed Police) CK Meen confirmed the daily to the two, saying that both were brought back last week. He said that departmental investigations against them were still pending. However, he refused to comment on canceling the suspension order.

The complainant had claimed that her husband and brother-in-law, both of whom were head constables of the Delhi Police, were suspended for the criminal case of 2012, which was resolved mutually.

Earlier the women had alleged that her family was being persecuted after Chief Justice Gogoi was terminated as an employee of the Supreme Court.

In its April 19 complaint, the woman had alleged that on October 10 and October 11 last year, CJI Rajan Gogoi had made sexual advances in her residence office and touched her improperly. She also claimed that she was transferred after the alleged incident, and on 21 December, in order to investigate against him for questioning senior officials about changing her posting and taking leave without authorization, was suspended from the service.

An inquiry committee was constituted to probe the allegations against CJI Ranjan Gogoi. The in-house committee, which was headed by Justice SA Bobde, said it found “no substance” in the sexual harassment allegations against Ranjan Gogoi and gave the CJI a clean chit

Meanwhile, a Crime Branch official told The Indian Express that when her husband was facing departmental investigation to call her in the CJI’s office, her brother-in-law allegedly reported “unethical behavior” against her “To hide the police complaint of 2015. Later, a joint investigation was ordered against both men and they were suspended in December last year, the official said.

The woman’s brother-in-law told the Indian Express that he and his brother had been reinstated. “We were reinstated some days ago and now we hope that they will also stop our departmental investigation because we are innocent. My brother is currently in Mumbai for treatment of his wife’s ear,” was told by daily.

Daily told that when a police officer is placed under suspension, the officer gets half the salary and he has to report for work, but no one is allotted it. If the suspension order is canceled, the officer is paid full pay and is put back on the job.

However, the final decision is taken on the basis of a departmental investigation.
