Karnataka Crisis: Rebel MLAs Can’t Be Forced To Participate In Trust Vote

Mumbai: While deciding on the petition of the rebel legislators of Karnataka, the Supreme Court gave full independence to the Speaker on Wednesday and said that they can reach the decision in a time-bound manner.

Reading the verdict, Chief Justice of India Ranjan Gogoi said, “The President has been given the freedom to decide on the resignation of 15 MLAs within any time limit.”

Meanwhile, the apex court said that the MLAs can not be forced to participate in tomorrow’s vote of confidence. In this incident that all the 15 legislators are absent from the assembly, the ruling Congress-JD (S) government will be top.

Describing the decision of the Supreme Court in the rebel legislator case, KR Ramesh Kumar, Chairman of the Karnataka Legislative Assembly, said that due to this order his responsibilities have increased.

Speaking with India Today he said, “By doing this, Supreme Court has further increased my responsibilities. It is not that they have authorised me to do whatever I want. It is a very sensitive implied direction that they’ve given me that the privilege conferred on you by the virtue of constitution must be exercised very judiciously. I will try to live up to the confidence of the Supreme Court,” Speaker Ramesh Kumar said in his first reaction after the order.

While passing an interim order, the Supreme Court said, “Big legal questions should be decided and later only one answer should be worth.”

During yesterday’s hearing, the Supreme Court had pulled the speaker and asked him why he could not make the decision about resignation and disqualification within the next 24 hours. In response, the president replied that if allowed by the court, then he will decide on both resignation and disqualification by Wednesday.
