National Human Rights Commission Played An Important Role In Bringing Justice To The Nikita Tomar Massacre

Mumbai: A fast-track court on Friday sentenced two convicts to life imprisonment for the murder of Nikita Tomar, five months after the 21-year-old was shot outside her college in Ballabgarh. A fine of Rs 20,000 was also slapped.

Notably, the National Human Rights Commission has played an important role to provide justice.

Notice issued against the Haryana Police Department in December 2020 by the National Human Rights Commission for convicting the main accused under a petition for a fair inquiry into the Nikita Tomar murder case filed by Ashish Rai Law student (University of Mumbai) before the National Human Rights Commission Strict guidelines were given that the report of the entire incident should be placed before the Commission in the coming four weeks.

After the notice was issued by the Commission, the Haryana Police Department approached the petitioner Ashish Rai and assured him to settle the matter at the earliest.  And has played an important role in punishing the main accused by completing the investigation of the sensitive case with full readiness.  With this, the Honorable Court, while hearing the case on the fast track, sentenced the main accused to life imprisonment.

What Was The Case:

A 21-year-old female student who was shot dead by her jilted lover and his associate outside her college in Faridabad on 26 October has attributed the crime to ‘love jihad‘. They say that the Muslim family was forcing her to convert and marry the accused.

The incident took place late 26 October in the afternoon when the victim, Nikita Tomar, a final year student of B Com in the college, had exited the premises after appearing in an exam. A CCTV footage of the incident has gone viral on social media.

The accused, who arrived at the spot in a car, tried to pull the woman inside in a possible bid to abduct her. The woman, however, resisted after which one of the accused shot her. The police have arrested both the accused. During the preliminary investigation, it has emerged that one of them was known to her.

One of the accused identified as Tausif hailing from Sohna was known to the victim and a complaint against him had been lodged by the victim’s kin a few months ago for harassment and molestation but a compromise had been reached.

A family member has alleged that the accused, who belongs to the Muslim community, had been forcing the girl to convert to her religion for the last three years. When she refused to convert to Islam, the accused tried to abduct her and shot her dead in the broad daylight.

“He tried to forcibly make her sit in his car but she refused and then he shot her,” the victim’s father said. Nikita’s father had earlier in 2018 filed a molestation complaint against Tausif.

The FIR cites the father alleging that Tausif had tried to abduct Nikita Tomar, as the daughter had told the father. There was a lot of pressure on the family due to which they later withdrew the case.

According to the police, Tausif was very angry at Nikita Tomar as she had stopped taking calls from him and she had blocked his number. The accused knew that she will be taking her exam yesterday and he was waiting for her along with his friend outside the college.
