Nirbhaya Convict Files Curative Petition In Supreme Court Days Before Hanging

A remedial plea is the last legal recourse available to a convict and is usually considered in the chamber

Mumbai: As the court issued death warrants against all four convicts in the 2012 Nirbhaya Delhi gangrape case, one of the convicts on Thursday filed a curative petition in the Supreme Court.

Vinay Sharma’s lawyer AP Singh said that a curative petition has been sought in the Supreme Court to ban the death penalty. Four convicts of the sensational 2012 Nirbhaya gang rape and murder case will be hanged in Tihar Jail on January 22 at 7 am.

In the petition, the council said that SC should have considered that Vinay was only 19 years old at the time of the incident. Young age and socio-economic background should be considered as mitigating factors.

The SC has sentenced the death sentence to life imprisonment in 17 other cases of rape and murder including minors. Vinay should be equally relieved, the plea mentions.

The Supreme Court on 18 December rejected Akshay’s plea seeking a review of its decision, stating that the review petition was not a “re-hearing of repeated appeals” and that it had already passed the death sentence. Restrictions were considered to reduce and worsen the conditions.
