Nirbhaya Gangrape Case Convict Pawan Kumar Gupta’s Curative Petition Dismissed By SC

The Supreme Court has already rejected remedial petitions of the remaining three

Mumbai: In another development in Nirbhaya Case Supreme Court on Monday dismissed the curative petition filed by Pawan Kumar Gupta, a death row convict in the Nirbhaya gangrape and murder case.

ANI quoted Justice NV Ramana saying, “The application for an oral hearing is rejected. The application for stay of execution of the death sentence is also rejected. The Curative Petition is dismissed in terms of the signed order.”

The five-judge Constitution Bench headed by Justice NV Ramana comprises Justice Arun Mishra, Justice RF Nariman, Justice R Banumati and Justice Ashok Bhushan.

Gupta on Friday filed a curative petition before the apex court seeking his death sentence for his death sentence. He is the fourth convict to file a curative petition.

The Supreme Court has already rejected remedial petitions of the remaining three.

It is a fresh death warrant issued by the trial court for the four convicts – Vinay Sharma, Akshay Thakur, Pawan Gupta and Mukesh Singh, who order their execution in Delhi’s Tihar Jail at 6 am on 3 March.

Meanwhile, the apex court has also fixed the date of March 5 for hearing a petition filed by the Union Home Ministry seeking direction to separately hang the accused in the Nirbhaya gang-rape and murder case.

The case relates to the gang rape and murder of a 23-year-old paramedical student in a bus on the night of 16 December 2012 by six people, including a teenager, in Delhi. The woman died a few days later in a hospital in Singapore.
