No Person Can Be Forcibly Vccinated Without Consent: Govt To Supreme Court

Mumbai: The Centre has recently updated the Supreme Court that as per the COVID19 guidelines issued by the ministry of health it cannot forcibly vaccinate an individual without obtaining the consent of his or her.

In an affidavit filed in the top court, the government also said that though the ministry urged everyone to take the COVID vaccine jab, it never compelled anyone to vaccinate “against their will”. Also Read: India Sees 2.58 Lakh New COVID Cases, Positivity Rate Rises From 16.28% To 19.65%

On the issue of exempting persons with disabilities from producing vaccination certificates, the Center told the top court that it has not issued any SOP which makes it mandatory to carry vaccination certificates for any purpose.

PTI reported that the Center was responding to a petition by NGO Evara Foundation, seeking door-to-door, priority COVID-19 vaccination for persons with disabilities.

“It is submitted that the guidelines and guidelines issued by the Government of India and the Ministry of Health and Family Welfare do not envisage any forced vaccination without obtaining the consent of the person concerned,” the affidavit filed on behalf of the ministry said.

“It is submitted that vaccination for COVID-19 is of greater public interest in view of the ongoing pandemic situation,” it added.

The ministry further said that “it is duly advised, advertised and communicated through various print and social media platforms that all citizens should get vaccinated and systems and procedures have been devised to facilitate the same.”

“However, no person can be forced to be vaccinated against their wishes,” it said.
