Prove Tweets By Nawab Malik Are False: Bombay HC To Sameer Wankhede’s Father

Mumbai: Bombay High Court has asked NCB officer Sameer Wankhede’s father to prove tweets by Maharashtra minister Nawab Malik against his son are false in the ₹1.25-crore defamation suit against Malik.

A single-judge bench of Justice Madhav Jamdar told him that it was up to the father to prove that what Malik was saying was wrong, reported NDTV, saying that as a public official, the public has the right to examine the NCB officer.

“You have to prove prima facie that what he is saying is false. The son is not an individual. He is a public official and any member of the public can examine him… Show me every tweet and how according to you it is false,” the judge added.

The high court also asked Malik to submit an affidavit showing that he had verified Samir Wankhede’s tweets of being Muslim as well as his birth certificate as per Live Law.

According to NDTV, the court said, “I want an affidavit from you that the information is verified. It could be a one-page affidavit.”

The statement came when the court was hearing the Wankhede defamation case against Malik. Wankhede has demanded Rs 1.25 crore from Malik for making the defamatory statement, which later started by sharing Sameer Wankhede’s birth certificate on social media and accusing his father of being a Muslim.

In the suit, the plaintiff, Dhyandev Wankhede, claimed that the remarks made by Malik, either verbally or in writing, against the Wankhede family were “derogatory and derogatory”.

Apart from Rs 1.25 crore, Wankhede has requested the court to ensure that Malik removes derogatory statements, press releases and tweets about his family, and has also sought preventive measures for the same.
