SC Dismisses Convict’s Review Plea In Nirbhaya case

Mumbai: The Supreme Court rejected a petition filed by one of the four convicts in the Nirbhaya gang rape and murder case, seeking a review of the 2017 decision to uphold his death sentence.

A three-judge bench headed by Justice R Banumathi said that there is no basis for reviewing the 2017 verdict and the satisfaction raised by convict Akshay Kumar Singh had already been considered by the apex court in the main court.

The top court said that it found “no errors” on the face of the main review, requiring any review.

As soon as the bench gave its verdict, advocate AP Singh, pleading guilty, sought three weeks’ time to file a mercy petition before the President.

Solicitor General Tushar Mehta, appearing for the Delhi government, told the bench that a week has been prescribed under the law to file a mercy petition.

The bench said, “We are not expressing our view in this regard. If by law any time is available with the petitioner, it is for the petitioner to take advantage of the remedy of filing the mercy petition within that stipulated time.

While delivering the verdict, the bench said that the convict has again sought to accept the prosecution case and the findings of the courts thereon and cannot be allowed.

The bench said that the grounds raised by Akshay were similar to the grounds taken by the other three convicts in the case, whose review petition was rejected by the apex court last year.

Regarding Singh’s subordination to the alleged flaws in the investigation, the bench said, “All these things have already been considered by the trial court, the High Court and the Supreme Court.
