SC Dismisses Nirbhaya Convict’s Plea Seeking Action Against Former Lawyer

Mumbai: The Supreme Court dismissed the withdrawal of a petition filed by Mukesh Singh, one of the four convicts in the 2012 Nirbhaya gang rape and murder case.

A bench headed by Justice Arun Mishra dismissed the petition saying that Mukesh Singh had taken advantage of all the measures and the petition was not upheld.

ANI quoted Justice Mishra, “Your curative petition has been dismissed. How can we pass orders against our own orders? … You have taken advantage of the legal remedies. You have availed the mercy plea. Thereafter warrants have issued. What is your option now? Only curative can be filed.”

Advocate Manohar Lal Sharma, appearing for Mukesh, said the court proceedings were based on fraud and said the former counsel should have waited for three years to file a curative petition.

Sharma told the apex court that it cannot compel him to file a curative petition and he would have to wait for three years to file it.

“Filing of the review petition is your choice, not remedy,” Justice Mishra responded.

On Friday, Mukesh Singh’s current lawyer filed a petition in the Supreme Court against his former lawyer Vrinda Grover, alleging that Grover had a criminal conspiracy against Mukesh with the Delhi Police.

The petition states that according to the law, the former lawyer could wait for three years to file a curative petition, but intentionally filed a curative petition to ensure that the petition is dismissed and Mukesh is hanged.

The Delhi court on Thursday sentenced the four convicts – Pawan Gupta, Vinay Sharma, Akshay Singh Thakur, and Mukesh Singh to be hanged on March 20 at 5:30 am.
