SC Notice To Civil Aviation Ministry, DGCA On PIL Seeking Refund Of Cancelled Air Tickets

Mumbai: Civil Aviation and Directorate General of Civil Aviation (DGCA) on a Public Interest Litigation (PIL), directing the airlines to refund the full amount of cancelled air tickets due to cancellation of flights.

A three-judge bench headed by Justice NV Ramana and headed by Justice Sanjay Kishan Kaul and Justice BR Gavai was hearing a petition filed by an NGO called Pravasi NGO Cell.

The PIL states that airlines are providing valid credit shells for up to one year instead of providing full refunds to their passengers, a clear violation of the May 2008 civil aviation requirement issued by the DGCA.

A petition was filed against “arbitrary action” on behalf of domestic and international flights “not refunding the full amount” collected for tickets due to cancellation of flights in view of lockdown restrictions.

It added that the DGCA also stated that in case of credit card payments, refunds will be made by the airlines within 7 days of the cancellation of the credit cardholders’ account, while in case of a cash transaction the refund shall be “made immediately” by the airline office from where the ticket was purchased.

The petition also sought instructions from the Union of India and others for airlines operating domestic and international flights in India to refund the entire amount collected for tickets ever booked for travel during the COVID lockdown.
