SC To Form Committee Headed By Retired Judge To Probe PM’s Security Breach In Punjab

Mumbai: Supreme Court on Monday agreed to set up an independent committee to probe PM Narendra Modi’s security breach in Punjab last week. The committee will be headed by a former Supreme Court judge.

Meanwhile, a three-judge bench headed by Chief Justice NV Ramana asked the Central and Punjab governments not to pursue their probe in the matter. The other members of the bench are Justices Surya Kant and Hema Kohli.

The decision came after the Punjab government requested a court-monitored probe into the incident.

After it was pointed out that the Center has issued show-cause notices to the Punjab officials, the Supreme Court told the Center that the notices issued by it to the Punjab officials were self-contradictory.

The court said that whether there has been any violation of the SPG Act, a Central Committee is being constituted to investigate it and on the other hand the Chief Secretary and Director General of Punjab is being held responsible.

“There is a breach and the Punjab government has admitted as well. The question is if an inquiry is held, what will be its scope. If you want to take disciplinary action against officers what remains for this court to look into?” the Court asked.

During the hearing on Monday, the Advocate General of Punjab Government DS Patwalia told the Supreme Court that the Registrar General of Punjab and Haryana High Court has considered the records.

The Punjab government also said that seven show-cause notices have been issued to the state officials as to why disciplinary action should not be taken against them. “Please appoint an independent committee and give us a fair trial,” the state government said.

Solicitor General Tushar Mehta, appearing for the Centre, told the Supreme Court that show-cause notices were issued to the DG and Chief Secretary of Punjab before the proceedings of the Central Government Committee were stopped. He said that the appointed committee did not do any hearing.

During the hearing, Punjab’s Advocate General DS Patwalia said that the government has issued seven show-cause notices to the officials seeking explanation as to why action should not be taken against them for the incident.
