Supreme Court Stays Allahabad High Court’s Lockdown Order In 5 UP Cities

Mumbai:  The Supreme Court on Tuesday stayed the order of the Allahabad High Court, directing the Uttar Pradesh government to lockdown in five cities of the state.

The order came soon after the UP government moved the apex court, challenging the Allahabad High Court order issued yesterday.

Putting an interim stay on the HC’s order, the Supreme Court bench asked the state of Uttar Pradesh to present various steps and measures to control the pandemic within a week before the Allahabad High Court.

The High Court yesterday directed the Uttar Pradesh government to impose lockdown in five major cities  Lucknow, Allahabad, Kanpur Nagar, Varanasi and Gorakhpur to curb the spread of coronavirus.

In its plea, the Uttar Pradesh government had contended that it is not in the domain of the Allahabad High Court to issue such kind of directions. The Chief Justice of India-led bench of the Supreme Court had agreed to hear the matter on an urgent basis today.

The High Court yesterday ordered the state government to hold a week-long lockout in Lucknow, Allahabad, Kanpur Nagar, Varanasi and Gorakhpur.

The UP government yesterday reacted to the HC’s order and said that no “complete lockout” would now be done in these cities.

The order was passed yesterday by a bench of two judges of Allahabad HC comprising Justices Siddharth Verma and Ajit Kumar. The bench was hearing a Public Interest Litigation on the manner in which quarantine centres were being run in the state and on the treatment of coronavirus patients.

“We believe that in the given scenario of the present time if people are prevented from going out of their homes for the first time for a week, then the current chain of the spread of COVID infection can be broken and this will also give some respite to the frontline medical and health workers” the court had said.

“Accordingly, we are passing the directions in respect of cities of Prayagraj (Allahabad), Lucknow, Varanasi, Kanpur Nagar and Gorakhpur and we direct the government to strictly enforce them forthwith,” it added.
