What Is President’s Rule, Which Is Applied In Maharashtra

Mumbai: Not a single party staked claim over govt formation, Maharashtra govt has applied Presidential rule in the state.

Well, President’s rule is a suspension of state government and imposition of direct central Government rule in the state. This could also happen if a party fails to form the government in the state.

Under Article 356 of the Indian Constitution, if state government is unable to function according to constitutional provisions, the Central government can take direct control of the state machinery.

Here in Maharashtra firstly BJP was invited by Governor to form its Government then Shiv-Sena but both of them have failed and today NCP also failed to do the same as a result Maharashtra Governor has implemented Presidential Rule in the state.

Once the President rule is applied it can be there for 2 months. If it needs to be extended then they need approval from both Parliaments. If they get approved then it can be extended for 6 months. It can happen 2 times which means the President’s rule can be imposed for 1 year.

If this 1-year election does not happen then that state is considered to not have a suitable atmosphere to conduct the election. This report is to be given by Election Commission. And if the report has been given then again after taking approval from Parliaments this rule can be extended to 3 years. That’s the maximum limit President’s Rule can be applied over any state given by the article.

There is President’s rule in Jammu Kashmir and on 3rd July it has been extended by 6 months, a meeting of the Union Cabinet, chaired by Prime Minister Narendra Modi has decided this.

In India, there were many instances when President’s rule has been applied. In July 2019 Amit Shah in his speech said to date there were 132 instances in the country where President’s rule was applied. In 93 instances there was Congress in the Central Government when this rule was applied.

In the History of India, when Indira Gandhi was PM then most times President Rule was applied. In her time she used this article almost 50 times to apply this rule. Manmohan Singh and the UPA government in 10 years has applied this rule 12 times. Manipur is the state that has been in the most number of times under this President’s rule.    

Chhattisgarh and Telangana are the only states where the president’s rule has not been imposed so far.
