Girls Should Control Sexual Urges, Not Give In To 2 Minutes Of Sexual Pleasure: Calcutta HC

Mumbai: Hearing a teenager’s request against his conviction in a rape case, Calcutta High Court laid down duties adolescent girls and boys should follow.

“Control sexual urge/urges as in the eyes of the society she is the looser when she gives in to enjoy the sexual pleasure of hardly two minutes,” the court said in duties for girls. The teenager last year was sentenced to 20 years in prison by a sessions court for having sex with his romantic partner, who is a minor.

The girl had informed the court during the hearing that she was in a relationship of her own free will and that she later got married to him. She added that their connection was illegal since in India, a person must be 18 years old to provide consent for sex.

Under the Protection of Children from Sexual Offences Act, consent granted by an individual under the age of 18 is deemed invalid, and engaging in sexual activity with them is considered rape (POCSO).

A two-judge panel made up of Justices Chitta Ranjan Dash and Partha Sarathi Sen overturned the sessions court’s decision and advocated for comprehensive sex education in schools to prevent future legal issues stemming from early sexual encounters.

The bench stated that although teenage sex is common, arousing such an impulse depends on the person, who may be a male or woman.

Girls were admonished by the court to resist giving in to their two-minute sexual urges.

“Control sexual urge/urges as in the eyes of the society she is the looser when she gives in to enjoy the sexual pleasure of hardly two minutes,” the court said.

Additionally, the bench stated that teenage girls had an obligation to defend their “right to the integrity of her body, dignity, and self-worth”.

It also said that males should instill in their thoughts a regard for women and for a girl’s dignity.

“It is the duty of a male adolescent to respect the aforesaid duties of a young girl or woman, and he should train his mind to respect a woman, her self-worth, her dignity and privacy, and the right to autonomy of her body,” the court said.
