SIT Says That Lakhimpur Kheri Case Was Well Planned, Seeks Inclusion Of New Sections Against 13 Accused

Mumbai: On October 3, the Special Investigation Team (SIT) probing the Lakhimpur Kheri violence filed fresh sections against 13 accused on charges of attempt to murder before the Chief Judicial Magistrate (CJM) to make their offence punishable.

SIT’s Investigating Officer Vidyaram Diwakar filed an application in the CJM court last week seeking to add new sections in the warrant instead of sections 279, 338 and 304A of the IPC.

In his application, the Investigating Officer stated that the incident was well-planned and a willful act and not negligence or negligence.

Investigating officer amended section 279 to add 307 (attempt to murder), 326 (voluntarily causing grievous hurt by dangerous weapons or means), 34 (act done by several persons with common intention)  of the Indian Penal Code after replacing sections 279 (Rash driving or riding on a public way), 338 (Whoever causes grievous hurt to any person by doing any act so rashly or negligently) and 304A (Causing death by negligence) of the IPC.

On October 3, eight people, including four protesting farmers, were killed when the SUV of Ashish Mishra, son of Union minister Ajay Mishra Teni, rammed into an SUV.

A local journalist also died in the violence.

The SIT has so far arrested Ashish Mishra, Lavkush, Ashish Pandey, Shekhar Bharti, Ankit Das, Latif, Shishupal, Nandan Singh, Satyam Tripathi, Sumit Jaiswal, Dharmendra Banjara, Rinku Rana and Ullas Trivedi.

They are lodged in the Lakhimpur Kheri district jail.
