Man Granted Divorce By Bombay HC After Wife Uploads Her Profile On Matrimonial Sites

Mumbai: Bombay High Court’s Nagpur bench granted divorce to an Aurangabad man after his estranged wife uploaded her profile on two matrimonial websites for marriage even as their divorce proceedings were pending.

In her profile, the woman declared she was “awaiting divorce.”

A division bench of Justices AS Chandurkar and GA Sanap said the uploading of the profile was a clear indication that she “decided to get rid of her estranged husband” and remarried before deciding on the family’s divorce.

It is noted in the profile, she said that she is waiting for a divorce. “In our opinion, the respondent (wife) abetted his intention by uploading his profile on two matrimonial websites,” the court said.

“On the basis of this document, it can be inferred that she wanted to get rid of the appellant and remarry.”

The couple got married in July 2014 and started living in Panjim, where the husband was posted at that time. But soon the woman started complaining that she was uncomfortable in Panjim and insisted her husband to quit his job and shift to Akola.

The husband refused and an altercation ensued, and after nine months of marriage, in April 2015, the wife left Panjim to prepare for competitive exams. Later she took away all her personal belongings, for which the husband had to approach the family court in Akola for divorce.

On December 7, 2020, the family court dismissed the husband’s divorce petition but allowed judicial separation on grounds of cruelty. The husband moved to the High Court, which divorced her on Friday.

The High Court refused to believe the woman’s claim that she was harassed for failing to meet the dowry demands and was eventually thrown out. It was held that the woman’s conduct was inconsistent with the facts stated by her – that she faithfully performed her duties as an obedient wife and daughter-in-law, but her husband and in-laws did not like her and wanted to get rid of it.

The bench said that the evidence clearly indicates that the woman had no desire and desire to be with her husband.
