Sabarimala Verdict: In Majority Verdict, Supreme Court Refers Review Petitions to 7-Judge Bench

Mumbai: Supreme Court while reading the verdict over Sabarimala Temple has ordered to review petitions filed against its ruling in September 2018 on the Sabarimala case, sending all review pleas to a seven-judge bench by a 3-2 majority.

A constitution bench headed by CJI Ranjan Gogoi referred a batch of review petitions against its September 2018 decision to allow a large constitution bench to allow women of all age groups to enter the Sabarimala temple.

The split 3: 2 ruling saw Justice Rohinton Fali Nariman and Justice DY Chandrachud dissatisfied.

The bench passed an order on petitions seeking reconsideration of its September 2018 decision prohibiting women from performing menstrual worship at Sabarimala temple in Kerala.

Reading the order on Thursday, the outgoing CJI Ranjan Gogoi observed that women’s entry into places of worship was not limited to Sabarimala alone, but included women’s entry into mosques as well as Parsi temples.

The top court, in a historic 4: 1 judgment, set aside decades-old restrictions on the entry of women between 10 and 15 years of age inside the temple.

The verdict had sparked a series of protests across the state. This led to 65 petitions for review of the order of the apex court. The petitions challenged the court’s right to interfere with the trust of the people.

It argued that the Sabarimala deity is a “Brahmachari” (Brahmachari) and that “centuries-old beliefs” should not be disturbed by the entry of women worshipers who menstruate.
