Setback For Devendra Fadnavis: Maha CM To Face Trial For Filing False Poll Affidavit In 2014

Mumbai: Maharashtra Chief Minister Devendra Fadnavis paved the way for his prosecution for not disclosing two pending criminal cases in his 2014 election affidavit in a major flaw to the Supreme Court on Tuesday. The SC quashed the order of the Bombay High Court, which barred the trial court from investigating the complaint against Fadnavis.

The SC allowed the trial court to consider whether the Maharashtra CM had concealed the criminal cases in the nomination papers. This development comes in the days before the state elections to be held on October 21.

The setback comes as Devendra Fadnavis is going to file his nomination for the 2019 Maharashtra assembly elections from Nagpur South today.

The verdict comes in a petition filed by lawyer Satish Uke seeking disqualification for not disclosing two pending criminal cases in his 2014 electoral affidavit. It was argued that the Chief Minister did not disclose the information required under the Election Act and that the disclosure of these two pending criminal cases was in violation of Section 125A of the RP Act and is an offence in itself.
