Bombay High Court Upholds Maratha Reservation For Maharashtra

Mumbai: The Bombay High Court upheld the Maratha reservation given by the Maharashtra government on Thursday. A group of petitions challenged their constitutional validity of quota.

Prior to this, on November 30 last year, the state’s heritage has passed a reservation of 16 per cent for the Maratha community under the social and educationally backward category (SEBC) category.

The Bombay High Court asked 12 per cent reservation for Marathas and 13 per cent in the recruitment of government jobs in educational institutions, the agencies said.

The decision of the state government was challenged by a group of petitions which claimed that quota violated the basic principle of limiting reservation to up to 50 per cent.

On 6th February, the Bench of Justice Ranjit More and Bharti Dangre started hearing the petitions which were closed in April this year. The State Government while defending its decision said that the Maratha community was given reservation for its upliftment.

However, it has been said in the petition that the state government has destroyed the concept of equality by establishing a special category – socially and educationally backward class (SEBC).

It has also been argued in the petitions that caste-like Kunbis, another community in the states, Marathas should be included in the other Backward Classes (OBC) category, under which Kunbi has been given reservation.

It has been viewed as the political victory of CM Devendra Fadnavis, the BJP-ruled government had agreed to create a quota for the Maratha community after a long movement.
