SC Issues Notice To Maha Dy Speaker On Rebel MLAs’ Pleas, Next Hearing On July 11

Mumbai: The Supreme Court on Monday issued notice to Maharashtra Deputy Speaker Narhari Zirwal on pleas filed by rebel MLAs challenging the disqualification notice issued to Shiv Sena’s Eknath Shinde and 15 other rebel MLAs.

“Haste can lead to undesirable consequences,” the top court told the deputy speaker.

The Supreme Court asked the Maharashtra government to ensure the safety of 39 disgruntled MLAs and their family members. The Supreme Court has asked Maharashtra Deputy Speaker Narhari Jirwal to file a detailed affidavit regarding the no-confidence motion moved against him by the Eknath Shinde-led rebel Shiv Sena camp. Also Read: Balasaheb’s Sena Supporting Those Linked To Mumbai Blast, Better To Die: Shinde

The direction was issued by the top court after the deputy speaker questioned the authenticity of the expulsion motion by the rebel camp. The Shinde faction had filed the eviction notice on June 22 under Article 179 of the Constitution and Rule 11 of the Maharashtra Legislative Assembly Rules.

After the Supreme Court sought all records from the deputy speaker’s office, his counsel Rajeev Dhavan told the bench that he questioned the authenticity of the removal motion as it was sent through an email.

Earlier, the Supreme Court had asked the rebel faction why didn’t they approach the high court. Neeraj K Kaul, the lawyer representing the Shinde camp, responded by saying, “Threats to us and our families make it non-conducive to pursue cases in Mumbai.”
